Please read these Terms of Use (“Terms”, “Terms of Service”) carefully before using our Website (tinybee.kidsbeetv.com), the application tinyBee (“App”), or any other online services that link to this Terms (collectively the “Services” or “tinyBee”) operated by Magikbee Lda (“us”, “we”, or “our”).

These terms are intended for parents and legal guardians, and users of the Services.

Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Services.

By accessing or using the Services you agree to be bound by these Terms. If you disagree with any part of the terms you may not be able to access the Services.

1. About the App

TinyBee is a safe app for kids that includes videos and learning games curated by teachers and education specialists, and that is aimed at children between 1 and 5 years old. Our App can be used on different devices: mobile phones, tablets, and smart TVs.

2. Privacy Policy

Your use of the Services is subject to our Privacy Policy. Please review our Privacy Policy, which also governs the Services and informs users of our data collection practices.

2.1. Controller Identification

All the data provided by you when using our Services will be processed by MAGIKBEE, LDA., a company with the VAT number PT513575820, whose registered address is 18A, 1º Frente, Rua de São Victor, Braga, Portugal.

3. Subscription

A subscription gives you unlimited access to all content available on tinyBee as long as it is active: videos, games, educational activities, and weekly updates! 

3.1. How it works on iOS

  • Payment will be charged to Apple Account at confirmation of purchase.
  • You can cancel online anytime – there is no cancellation fee.
  • You can use the subscription on any device registered with your Apple account.
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Account will be charged for renewal within 24 hours prior to the end of the current billing period, and identify the cost of the renewal.
  • Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings on the Apple device after purchase.
  • Cancellation will not go into effect until the end of the billing cycle.
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription, where applicable.

3.2. How it works on other platforms

  • Subscriptions are renewed weekly, monthly, or annually, depending on your subscription plan.
  • Your subscription is valid on any device registered to your tinyBee account.
  • Your subscription is renewed automatically unless you disable automatic renewal at least 24 hours before the end of the current billing period.
  • The next payment will be charged 24 hours before the end of the current billing period.

  • In case you subscribed to tinyBee through our Website, contact us to manage your subscription: support@magikbee.com.
  • The cost of the current subscription plan cannot be refunded, and service cannot be stopped in the middle of a billing period.
  • Any free trial, as applicable, will be interrupted when a paid subscription is purchased.
  • On Android, you may choose to access tinyBee for free in an ad-based version. All ads are safe and kid-friendly.

4. Free Users or Users without a subscription

A limited part of the Services’ content may be made available for free to users of the App and unlocking any additional content will require registering for the subscription service. Android users may have the additional option of accessing all content on a free version with kid-friendly advertisements (also called the “AVOD version”).

5. Account

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services.

Every account has one designated adult user (“adult user”, “parent” or “legal guardian”) who must be at least 18 years of age. 

You are responsible for safeguarding the password if you use one to access the Services, as well as for any activities or actions under that password, whether your password is with our Services or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

6. Content

TinyBee is a kids’ streaming service that also includes educational games. All the shows displayed are licensed for the purpose of distribution within the Apps and are age-appropriate.

TinyBee reserves the right to modify the content available at any time without notice.

7. Intellectual Property

The Services and all their content, such as songs, videos, games, activities, stories, text, graphics, artwork, and the trademarks, logos, button icons, features, and functionality are and will remain the exclusive property of Magikbee Lda and its Licensing Partners. The Services are protected by copyright, and other laws of both Portugal and foreign countries. You agree not to copy, distribute, sell, store, or in any other re-use material from the Services, unless Magikbee gives you express written permission to do so.

8. DMCA Complaints

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our Services, please notify us, as set forth in the Digital Millennium Copyright Act of 1998 (“DMCA”). For your complaint to be valid under the DMCA, you must provide us in writing (i) an electronic or physical signature of a person authorized to act on behalf of the copyright owner, (ii) an identification of the copyrighted work that you claim has been infringed, (iii) an identification of the material that is claimed to be infringing and where it is located on the Services, (iv) information reasonably sufficient to permit us to contact you, such as your address, telephone number, and, e-mail address, (v) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and (vi) a statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner. 9. Links To Other Websites

Our Services, in the areas meant for parents and legal guardians, may contain links to third-party websites or services that are not owned or controlled by Magikbee Lda. Magikbee Lda has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You further acknowledge and agree that Magikbee Lda shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We highly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

The areas of our Services that are meant to be used by children do not contain external links.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation, if you breach the Terms.

Upon termination, your right to use the Services will immediately cease. The termination will not affect your obligations to us, including any payment obligations to us, and you will not be entitled to a refund of any payments.

If you wish to terminate your account, you may simply discontinue using the Services.

11. Limitation Of Liability

In no event shall Magikbee Lda, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Magikbee Lda does not warrant that i) the Services will function uninterrupted, secure, or available at any particular time or location; ii) any errors or defects will be corrected; iii) the Services are free of viruses or other harmful components, or iv) the results of using the Services will meet your requirements.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have between us regarding the Services.

14. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. You agree that any modification on or replacement of these Terms will be effective immediately upon our posting them on the Services. If a revision is material, we will notify you prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

Any modification to provisions related to fees and billing shall not apply to fees incurred prior to the applicable modification.
